Overview of sales tax in New Hampshire

New Hampshire is one of only five states, joining Alaska, Montana, New Hampshire, and Oregon, with no statewide sales tax. The state does not impose any tax on retail sales of goods or services. This makes New Hampshire an attractive location for many businesses, especially retailers.

The lack of a sales tax stems from New Hampshire's tax policy focus on limited government and frugality. Instituting a sales tax would require an amendment to the state constitution. Efforts to impose a sales tax have been rejected by the legislature and voters numerous times.

New Hampshire also has no local sales taxes. Cities and towns cannot impose their own sales tax. This means the entire state is sales-tax-free.

Impact of South Dakota v. Wayfair supreme court ruling

The Supreme Court's South Dakota v. Wayfair decision in 2018 overturned the long-standing physical presence rule for sales tax nexus. However, the ruling did not affect New Hampshire ecommerce sellers, since there is no New Hampshire sales tax to collect.

Ecommerce sellers making sales to New Hampshire customers still have no sales tax collection or remittance responsibilities. Wayfair brought no changes to New Hampshire's tax policies.

Benefits of New Hampshire's zero sales tax

New Hampshire's lack of a sales tax provides several advantages:

  • Lower prices for consumers - Without a sales tax added at checkout, customers pay less for goods and services. This extra purchasing power boosts retail sales.
  • Increased business competitiveness - Companies can offer lower prices to attract more sales volume without a sales tax embedded in the price. This is especially impactful for retailers competing with online sellers.
  • Simplicity for business operations - Not having to deal with sales tax registration, collection, filing, and audits saves companies significant time and money. Compliance becomes much easier.
  • Promotional appeal - New Hampshire's "tax-free" status is a key marketing point for attracting shoppers from other states as well as new businesses.

New Hampshire's no-sales-tax policy provides tangible economic benefits and will likely continue into the future. Businesses considering New Hampshire can be confident they will not have to deal with sales tax complexities.
